Terms of agreement
Please read these terms carefully before funding a SIMPay wallet.
SIMPay user agreement
Applies to the web app, USSD, SMS and APIs.
1. Acceptance
By creating a SIMPay wallet, dialling the SIMPay USSD code, sending a SIMPay SMS command, or using the SIMPay web app or APIs, you agree to these terms. If you do not agree, stop using the service and do not fund your wallet.
You confirm you are at least 18 years old and legally able to enter this agreement in your country of residence.
2. Nature of the service
SIMPay provides software that generates and operates self-custodial blockchain wallets addressable by phone number, together with messaging, USSD and settlement tooling.
SIMPay is not a bank, is not a deposit-taking institution, and does not pay interest. Balances shown in the app represent blockchain assets and internal ledger entries, not insured deposits.
3. Self-custody and keys
Your wallet is derived from a BIP-39 recovery phrase created for you and stored encrypted. You may reveal and export it at any time after PIN verification.
You are solely responsible for safeguarding your recovery phrase, private keys, PIN and SIM card. Anyone holding your recovery phrase controls your funds.
SIMPay cannot reverse, freeze or recover a blockchain transaction, and cannot restore a lost recovery phrase on your behalf.
4. Phone number and SIM
Your account is bound to your phone number. If you lose control of that number, you may lose access to phone-based features, though your funds remain recoverable with your recovery phrase.
You must notify SIMPay promptly of a lost SIM, suspected SIM swap or unauthorised activity so the account can be restricted.
5. Transactions and finality
Blockchain transactions are irreversible once broadcast. You are responsible for verifying the recipient phone number, address, asset, network and amount before confirming.
Transfers to a phone number that is not yet registered are held in escrow and refunded to you if unclaimed within the stated window.
SIMPay may queue, delay or decline a transaction where required by law, where network conditions prevent settlement, or where fraud is suspected.
6. Swaps between crypto and local currency
Swap quotes are indicative until an order is created and are based on third-party FX rates and a stated service fee. Stablecoins are treated as equivalent to the US dollar.
Selling stablecoins debits your spendable balance immediately and creates a cash payout instruction to the payment details you supply. You are responsible for the accuracy of those details.
Buying stablecoins requires the cash payment to be received and confirmed before your wallet is credited. Unfunded orders expire.
7. Fees
Applicable fees are displayed before you confirm a transaction or swap and may change with notice. Network gas costs may be sponsored by SIMPay on supported networks and withdrawn at any time.
8. Referrals and rewards
Referral rewards are granted for genuine, unique users who complete the stated milestones. Self-referrals, duplicate identities, automated signups and any manipulation void all associated rewards.
SIMPay may adjust reward amounts, milestones and eligibility rules, and may reverse rewards obtained in breach of these terms.
9. Acceptable use
You must not use SIMPay for money laundering, terrorist financing, sanctions evasion, fraud, market manipulation, unlicensed money transmission, or any activity illegal in your jurisdiction.
You must not attempt to bypass authentication, PIN checks, rate limits, or access another user's account, keys or data.
10. Compliance and verification
SIMPay may request identity information and may limit, suspend or terminate access, or report activity to competent authorities, where required by applicable law or risk policy.
Transaction limits may apply based on verification level and corridor.
11. dApp and third-party connections
When you connect SIMPay to a third-party application, that application acts independently of SIMPay. Approving a signature or transaction request is your decision and may transfer or authorise the transfer of your assets.
SIMPay is not responsible for third-party smart contracts, exchange rates, outages or losses.
12. Availability and testnet status
The service is provided on an as-is and as-available basis. Portions of SIMPay operate on test networks where assets have no monetary value and data may be reset.
Scheduled and unscheduled maintenance, blockchain congestion and telecom outages may interrupt access.
13. Limitation of liability
To the maximum extent permitted by law, SIMPay is not liable for indirect, incidental, special or consequential losses, lost profits, or losses arising from your loss of a recovery phrase, PIN, SIM or device, from your own transaction errors, or from third-party network failures.
14. Changes and termination
SIMPay may update these terms; continued use after an update constitutes acceptance. You may stop using the service at any time and withdraw your assets using your own keys.
15. Governing law and contact
These terms are governed by the laws of the jurisdiction in which the SIMPay operating entity is registered, without regard to conflict-of-law rules.
